Completing a course, receiving an endorsement and submitting a qualifying application are different events. They can have different consequences for a Student founder. Check the switch requirements and current work conditions before trading, accepting a directorship role in practice or treating a business activity as permitted.

Establish the current immigration position

Record the actual permission held, expiry, course and study status. The official Founder switch page currently says a Student applicant must have completed the sponsored course or have studied a full-time PhD for at least 24 months. It also lists categories that cannot switch in-country. Do not infer that every graduate or visitor can apply from inside the UK.

Ask the university for written confirmation of the relevant course status and dates. An exam finishing, a dissertation being submitted and successful course completion may be different facts. If the situation involves interruption, resits, a changed award or unusual study history, obtain a specific assessment before relying on the standard description. The university can explain its records; immigration advice may be needed for the legal consequence.

Keep preparation and activity distinct

A student can research a genuine venture, but particular work or business activities can be restricted under Student conditions. Do not assume that unpaid activity, an overseas customer or a company registered in someone else's name removes the issue. Describe the actual proposed conduct: ownership, duties, payment, contracts, location and statutory roles. Labels such as startup project or side hustle do not decide the classification.

The current Appendix Student, ST26.8 contains a defined exception relating to a qualifying endorsed Innovator Founder application made with Student permission while the decision or relevant review remains pending. Its conditions matter. An endorsement alone is not the same event as that application. Seek individual advice before relying on the exception to begin self-employment; do not turn it into a blanket statement that students may run any business after graduation.

Build the venture on genuine evidence

Use permitted preparation time to understand the customer problem, alternatives, founder contribution and available resources. Keep research and prototype work accurately described. Do not fabricate trading history or customer contracts to make the business appear mature. If a planned experiment might itself constitute restricted activity, clarify the position before carrying it out rather than collecting evidence first and asking later.

The endorsement assessment and immigration application are separate. A university enterprise programme, incubator place or company-registration certificate should not be presented as a visa endorsement unless the correct authorised process applies. Verify the current endorsing-body list and scope. Ask what the body will assess and what documents are needed, keeping the business case and personal eligibility workstreams in parallel.

Align the endorsement and application calendar

Map course completion or doctoral study threshold, current permission expiry, endorsement process, English and finances. Record the endorsement letter's issue date and the application window. Allow time for corrections and identity steps. A plan that assumes endorsement arrives on the final day of Student permission has little resilience if the body needs another document or the business requires more work.

Do not submit inaccurate evidence merely to record an earlier date. If the timing is tight, obtain prompt advice on the actual lawful options. An overseas application may raise its own requirements and practical constraints; a brief trip does not automatically solve every issue. Keep travel and housing commitments flexible until the application strategy is established.

Review family, money and study consequences

A principal applicant's switch does not automatically switch a partner or child. Record each person's current expiry and eligibility separately. Add the household's costs and evidence tasks to the timeline. Check whether a university scholarship or sponsor has conditions affecting the plan, and obtain any necessary genuine permissions or confirmations. Do not assume immigration permission overrides academic or contractual obligations.

Separate business capital, personal maintenance and living costs. An early-stage venture may not pay a salary for some time. Run a downside household budget and identify the money available if launch or endorsement is delayed. The decision to pursue a founder route should make sense commercially and financially rather than being a response to the end of a course alone.

Use a permission-sensitive action log

For each proposed activity, write what you intend to do, when, under which permission and what clarification exists. Keep advice and official records privately. If the business plan changes, review the activity classification and endorsement position again. Do not assume an earlier answer applies to a materially different arrangement.

The switch planner organises academic dates, activity questions, endorsement and personal evidence. It does not grant permission to trade or select a legal strategy automatically. Its value is making the exact facts visible early enough for a university team or regulated adviser to assess them, while the founder continues building a genuine and viable proposition within the applicable conditions.

A worked decision example

An illustrative student has developed a prototype and receives an endorsement while final course results are pending. A potential customer offers to pay for a pilot. The action log does not assume the endorsement alone permits trading. It records the proposed activity, current Student conditions, course status, application stage and the exact question for a regulated adviser. The founder also asks the university for genuine completion evidence and checks the switch timetable. This example does not classify the pilot or give permission to accept payment. Its purpose is to separate commercial interest, endorsement and immigration events so that a promising opportunity is not used as a substitute for checking the applicable conditions before activity starts.
